New regulatory amendments to Immigration and Refugee Protection Regulations
The Temporary Foreign Worker Program (TFWP) remains committed to providing stakeholders with up-to-date information on regulatory and program requirement changes. Please find a digital toolkit that has been developed to help employers and other stakeholders better understand the new program requirements and conditions resulting from the regulatory changes. The updated Temporary Foreign Worker: Your Rights Are Protected guide are also included below in English, French and Spanish. Additional foreign languages will be available soon online.
All Labour Market Impact Assessment (LMIA) applications received on or after Sept. 26, 2022 will be subject to these new regulatory amendments. In order to meet the new requirements, you are asked to complete the newest version of the LMIA form which will become available on the TFWP website beginning Sept. 26. In cases where an older version of LMIA application was completed, you are asked to complete an Addendum form and submit it along with your LMIA application. Otherwise, we will contact you and request that you complete the addendum.
Note: As of Oct. 25, 2022 employers must use the updated LMIA application forms. Please direct any questions regarding the LMIA application form addendum to the Employer Contact Centre by calling 1-800-367-5693.
Employers are encouraged to participate in the upcoming TFWP Compliance information session which is currently being scheduled for the fall. Should you wish to attend, kindly reply to the email address below to express your interest and a calendar invite will follow.
You can consult the final version of the new regulatory amendments to the IRPR on Canada Gazette, Part II.
